Terms and Conditions
Article 1 General Rental Conditions:
These Terms and Conditions apply to all rental agreements entered into with Paulina Car Rental. By entering into a rental agreement, the renter agrees to these Terms and Conditions. Only persons listed in the rental agreement as the renter or authorized additional driver may operate the vehicle. Drivers must be at least 23 years of age and hold a valid driver's license. At the start of the rental period, a valid driver's license and passport or identification document must be presented. The renter may not allow the vehicle to be driven by any person who is not listed in the rental agreement. The renter remains fully responsible and liable for the actions of any person operating or using the vehicle with the renter's permission. A standard deductible of USD 500 applies to each damage claim. The renter may reduce the deductible to USD 250 by purchasing the optional Comfort Cover for an additional fee of USD 13 per day.
Article 2 Reservation and Rental Period:
The rental period specified in the confirmed reservation is binding for both parties. A reservation becomes final once the rental company has received the required deposit or the first rental payment, if applicable. The rental agreement is entered into for the period and rental rate agreed upon at the time of the confirmed reservation. Paulina Car Rental reserves the right to refuse a rental request without providing a reason.
No cancellation fees will be charged if the reservation is cancelled before the start of the rental period. Paulina Car Rental reserves the right to cancel a reservation in cases of force majeure, unforeseen circumstances, or situations beyond its reasonable control.
Article 3 Condition of the Vehicle:
The renter acknowledges that the vehicle has been received in good condition and that Paulina Car Rental has delivered the vehicle in a roadworthy and satisfactory condition. At the end of the rental period, the renter must return the vehicle in the same condition as it was received, subject to normal wear and tear. The vehicle must be returned together with all keys, documents, accessories, and any other items provided with the vehicle. If the vehicle is not returned in the required condition or if any keys, documents, or accessories are missing, Paulina Car Rental reserves the right to continue charging rental fees until all missing items have been returned and the vehicle has been fully restored to the agreed condition. The renter hereby authorizes Paulina Car Rental, or any person designated by Paulina Car Rental, to recover, access, or take possession of the vehicle if necessary, wherever the vehicle may be located.
Article 4 Payment Terms:
The renter must pay the full rental amount, including the security deposit, before the start of the rental period. For long-term rentals, the renter must pay the first rental installment and the required security deposit before the rental period begins. If any rental payment is not made on time, the renter shall be considered in default without further notice. In such cases, Paulina Car Rental reserves the right to charge contractual interest at a rate of 10% per annum on any overdue amounts, in addition to any applicable collection or administrative costs.
Article 5 Liability, Fines, and Indemnification:
The rental and use of the vehicle are at the renter's own risk. The renter is responsible and liable for any damage, loss, injury, or claims involving the renter, passengers, third parties, or property arising during the rental period, except where such liability is excluded by applicable law. The renter agrees to indemnify and hold harmless Paulina Car Rental from any claims, damages, liabilities, costs, or expenses arising from the use of the vehicle during the rental period. The renter is fully responsible for all traffic fines, parking fines, penalties, sanctions, toll charges, and any other charges or measures imposed as a result of violations committed by the driver or occupants during the rental period. Any costs resulting from such violations, including administrative fees charged by Paulina Car Rental and/or third parties, shall be borne solely by the renter.
Article 6 Proper Use of the Vehicle:
The renter shall use the vehicle responsibly and with due care, as a prudent and responsible renter. The renter must ensure that the vehicle is used only for its intended purpose and in accordance with all applicable laws and regulations. All costs associated with the use of the vehicle during the rental period, including but not limited to fuel, cleaning, parking fees, tolls, and traffic-related expenses, shall be borne by the renter.
The renter shall not:- Rent, lease, or sublet the vehicle to any third party.
- Use the vehicle for driving instruction or driver training.
- Use the vehicle in races, competitions, speed tests, or similar events.
- Use the vehicle for commercial passenger transportation services.
- Use the vehicle for any unlawful or criminal activity.
- Use the vehicle to transport flammable, toxic, hazardous, illegal, or prohibited substances.
If the renter becomes aware of any damage, defect, malfunction, or safety-related issue affecting the vehicle, the renter must immediately stop using the vehicle if continued use could result in further damage, increase safety risks, or endanger any person or property. The renter must promptly notify Paulina Car Rental of any damage, defect, accident, theft, loss, or other incident involving the vehicle.
The renter is required to report any visible damage, defects, malfunctions, theft, loss, or disappearance of the vehicle to Paulina Car Rental as soon as reasonably possible. The renter is responsible for maintaining the vehicle in a proper condition during the rental period, including regularly checking and maintaining the engine oil level and tire pressure when necessary. The renter must comply with all applicable laws, regulations, and traffic rules at all times. The renter agrees to drive only on paved roads. The use of unpaved public roads leading to public beaches, private beaches (where access is permitted), or national parks is allowed only when such roads are officially open, accessible, and reasonably safe for normal vehicle use. Roads that are closed, restricted, or prohibited for public access may never be used. The use of alcohol, illegal drugs, narcotics, or medication that may impair driving ability before or during the operation of the vehicle is strictly prohibited. If the driver is under the influence of alcohol, drugs, narcotics, or medication that may impair driving ability at the time of an accident or damage-causing event, the renter shall be fully liable for all resulting damages, losses, claims, costs, and expenses. In such cases, any insurance coverage or limitation of liability may become void, and the full amount of the damage may be recovered from the renter.Article 6A Liability for Damage and Exclusions
The renter shall be liable for any damage to the rented vehicle resulting from a breach of the rental agreement or any failure to comply with the obligations set forth in these Terms and Conditions. Any limitation of liability, deductible reduction, insurance coverage, or optional protection package shall become void if damage results from:A violation of Article 6 of these Terms and Conditions.
Reckless or irresponsible driving.
Intentional acts or omissions.
Gross negligence or gross misconduct.
Driving under the influence of alcohol, illegal drugs, narcotics, or medication that may impair driving ability.
The use of the vehicle for unlawful purposes.
In such cases, the renter shall be fully liable for all damages to the vehicle, third parties, property, and any related costs.If the vehicle is driven off-road or on terrain not permitted under these Terms and Conditions, a minimum cleaning fee of USD 140 shall be charged for engine compartment and underbody cleaning, without prejudice to any additional repair or damage costs. Paulina Car Rental reserves the right to request an investigation by its insurer or other authorized parties in the event of a suspected violation of these Terms and Conditions. Police reports, witness statements, CRS reports, photographs, video evidence, or any other legally acceptable evidence indicating a breach of the rental agreement by the renter shall constitute sufficient grounds to hold the renter fully liable for all resulting damages to the rented vehicle, third parties, and property
Article 7 Vehicle Maintenance:
The renter shall comply with any reasonable request from Paulina Car Rental to make the vehicle available for routine maintenance, inspection, or servicing. Such requests will be communicated in a timely manner, allowing the renter a reasonable opportunity to comply without unnecessary inconvenience. For rental periods of one month or less, the renter is not required to make the vehicle available for routine maintenance during the rental period.
Article 8 Insurance and Deductible
All vehicles rented by Paulina Car Rental are insured under a Third-Party Liability (TPL) policy and supplementary comprehensive insurance coverage provided by Inter Assure. The renter acknowledges having been informed of the insurance coverage and accepts the applicable insurance terms and conditions upon entering into the rental agreement. The maximum Third-Party Liability coverage is ANG 150,000 per claim. A standard deductible of USD 500 applies to each damage claim unless the renter has selected the optional Reduced Deductible Coverage prior to the start of the rental period. Any damage exceeding the maximum insurance coverage shall be the sole responsibility of the renter. The renter agrees to indemnify and hold harmless Paulina Car Rental against any costs, claims, damages, or liabilities exceeding the available insurance coverage. The renter acknowledges responsibility for all damage to the rented vehicle arising during the rental period, whether caused by negligence, carelessness, recklessness, gross negligence, or intentional misconduct.
The following items are excluded from all insurance coverage and shall be entirely at the renter's expense:Glass damage, windshield chips, cracks, or breakage.
Flat tires and tire damage.
Damage to wheels, rims, hubcaps, or wheel covers.
Undercarriage damage.
Interior damage.
Loss of or damage to vehicle keys and/or remote controls.
Loss of or damage to vehicle keys and/or remote controls shall be charged to the renter with a minimum charge of USD 150.
Any damage, loss, or expense not covered by the applicable insurance policy shall be fully recoverable from the renter.
Article 9 Vehicle Security
The renter must ensure that the vehicle is properly locked at all times when parked or left unattended. The vehicle may never be left unattended or unsupervised while unlocked. The renter shall be fully responsible and liable for any loss, theft, damage, or other consequences resulting from failure to properly secure the vehicle. No valuable items, personal belongings, cash, electronic devices, luggage, or other property should be left inside the vehicle, whether visible or concealed. Paulina Car Rental shall not be liable for the loss, theft, or damage of any personal property left inside the vehicle during the rental period.
Article 10 Accidents, Theft, and Damage
The renter shall be liable for all losses resulting from theft, disappearance, or damage to the rented vehicle, regardless of whether such damage was caused by the renter, passengers, third parties, or other circumstances during the rental period. In the event of an accident, theft, damage, or any incident involving the vehicle, Paulina Car Rental must be notified immediately. A damage report must be completed through Curaçao Road Service (CRS) by calling 9233. Following an accident, the vehicle may not be moved from the scene unless authorized by the police, Curaçao Road Service, or another competent authority. Failure to comply with these requirements may result in the loss of insurance coverage, and the renter shall become fully liable for all resulting damages, losses, costs, and expenses. In the event of theft or disappearance of the vehicle, the renter shall be charged the applicable deductible of USD 500. In the event of theft, the renter must provide all vehicle keys to Paulina Car Rental. If the renter is unable to produce the vehicle key(s), the renter shall be liable for the full market value of the vehicle.If the renter fails to immediately settle the total amount due for damages, the renter shall be responsible not only for the deductible but also for all collection, recovery, legal, administrative, and related costs incurred by Paulina Car Rental.
Article 11 Breakdown Assistance and Replacement Vehicle
In the event of a mechanical breakdown or vehicle malfunction during the rental period that is not caused by the renter, Paulina Car Rental will make reasonable efforts to repair the vehicle as quickly as possible or, if available, provide a replacement vehicle. The repair period shall commence from the moment the breakdown or incident is reported to the emergency contact number provided by Paulina Car Rental. If repair of the vehicle is not possible within a reasonable time, Paulina Car Rental will, where available, provide a replacement vehicle of a similar category. The renter shall not be entitled to a replacement vehicle if the damage or breakdown resulted from:A violation of Article 6 of these Terms and Conditions.
Reckless or irresponsible driving.
Intentional acts or omissions.
Gross negligence or gross misconduct.
Driving under the influence of alcohol, illegal drugs, narcotics, or medication that may impair driving ability.
Any other misuse of the vehicle by the renter or an authorized driver.
If repair or replacement is not possible for any reason, Paulina Car Rental will refund the rental charges for each unused rental day during which the vehicle could not be used.
Article 12 Early Return, Late Return, and No-Show
If the vehicle is returned before the agreed return date, the renter shall remain liable for the full rental amount agreed upon in the rental agreement.
No refund shall be provided for unused rental days resulting from the early return of the vehicle. If the renter returns the vehicle later than the agreed return time without prior notification and approval from Paulina Car Rental, additional rental charges shall be applied on a prorated basis for the excess time. If the renter fails to collect the vehicle on the agreed pickup date without prior notice, Paulina Car Rental reserves the right to cancel the reservation and terminate the rental agreement. In such cases, any deposit, reservation fee, or security deposit paid may be retained by Paulina Car Rental in accordance with the rental agreement and applicable policies.
Article 13 Right to Cancel
Paulina Car Rental reserves the right to cancel a reservation or rental agreement without penalty to either party under certain circumstances, including but not limited to adverse weather conditions, natural disasters, government restrictions, safety concerns, force majeure events, or other circumstances beyond its reasonable control. Such cancellation may occur when, in the sole judgment of Paulina Car Rental, the safety of the renter, passengers, employees, or property may be at risk. In the event of such cancellation, Paulina Car Rental will make reasonable efforts to inform the renter as soon as possible and, where appropriate, offer an alternative vehicle, alternative rental dates, or a refund of any amounts paid.
Article 14 Security Deposit and Deductible
Upon entering into the rental agreement, the renter shall pay a refundable security deposit of USD 500. The primary driver shall be responsible for the actions and obligations of all additional drivers listed in the rental agreement. The security deposit may be paid by cash, credit card, debit card, or bank transfer, subject to the payment methods accepted by Paulina Car Rental. Paulina Car Rental reserves the right to deduct any damages, losses, unpaid charges, fines, administrative fees, or other amounts owed by the renter from the security deposit. The standard deductible is USD 500 per claim. If the renter chooses the optional Reduced Deductible Coverage before the start of the rental period, the deductible shall be reduced to USD 250 for an additional fee of USD 13 per rental day. In the event of damage, Paulina Car Rental shall determine the amount of compensation due based on the actual damage, repair costs, and any related expenses. Any remaining balance of the security deposit, after deduction of applicable charges, shall be refunded to the renter by cash or bank transfer. If no damage, loss, or outstanding charges are identified, the full security deposit shall be refunded to the renter.
Article 15 Care of the Vehicle and Misuse
The renter shall take proper care of the rented vehicle and use it as a prudent and responsible custodian throughout the rental period.
Paulina Car Rental reserves the right to immediately repossess or recover the vehicle without refund of rental charges if there is reasonable evidence or suspicion of misuse, abuse, unauthorized use, violation of these Terms and Conditions, or any activity that may endanger the vehicle, third parties, or the interests of Paulina Car Rental. For long-term rentals, the renter shall have the interior and exterior of the vehicle professionally cleaned by Paulina Car Rental at least once per month. The cost of this cleaning service is USD 20 (ANG 35) per cleaning and shall be borne by the renter.
Article 16 Governing Law and Jurisdiction
These Terms and Conditions are published by Paulina Car Rental, Curaçao.
All rental agreements and any legal relationship between the renter and Paulina Car Rental shall be governed exclusively by the laws of Curaçao.
Any dispute arising out of or relating to the rental agreement, these Terms and Conditions, or any matter connected therewith shall be submitted exclusively to the competent court of Curaçao. By making a reservation and entering into a rental agreement, the renter acknowledges having read, understood, and accepted these Terms and Conditions. Renters are advised to read these Terms and Conditions carefully before making a reservation.
